Filed petition to transfer Ramjas College incident plea: Cops

The Delhi Police today informed a court that it has filed a petition before a superior court seeking to transfer a plea for an FIR in the Ramjas College incident in which anti-national slogans were allegedly raised.

Metropolitan Magistrate Abhilash Malhotra was told that the power to deal with the cases of Delhi Police Crime Branch was vested with the Chief Metropolitan Magistrate (CMM).

Police said the magistrate has no jurisdiction to try the matter.

In its status report, it said the transfer petition has been listed for hearing before the CMM court for June three.

“I am of the opinion that since the transfer petition is pending, it will be prudent to wait for orders passed by the CMM in the said petition. Put up for further hearing on June 26,” the magistrate said and added that the CMM would decide the jurisdiction.

It is pertinent to mention that after filing of a complaint by advocate Vivek Garg, CMM Satish Kumar Arora had marked it to the court of magistrate Malhotra.

Complainant Garg had vehemently opposed the police’s plea saying it has been delaying the matter and hesitating to file a proper action taken report as it was not willing to probe the incidents.

Police, in its report filed in pursuance to court’s direction, said that an enquiry committee was constituted by the Commissioner of Delhi Police.

It said the committee has been enquiring into complaints relating to the incidents that occurred on February 21-22 this year and it has so far examined 62 witnesses, including student groups and police officials.

It sought time to conclude the enquiry and said necessary legal action will be taken on conclusion of the enquiry.

The court was hearing the complaint seeking lodging of an FIR into the February incidents during which anti-national slogans were allegedly raised at Ramjas College by members of students groups AISA and SFI.

The plea had said a similar incident had taken place in JNU last year. It alleged that “massive anti-national slogans/ activities were being carried out by leaders/students of AISA/SFI in Ramjas College, shamelessly and openly which supported India’s enemy i.e. Pakistan. The criminal acts of accused were also boosting morale of terrorists against our country.”

The complainant has alleged in the plea that such slogans were shocking, damaging for the country and an open challenge to its unity and safety and the judicial system.

It has alleged that organisers of the seminar had misled the college administration to obtain the nod for the event and “conducted activities against the nation and tried to wage a war against the country”.

It has sought lodging of an FIR for the alleged offences of sedition, criminal conspiracy, waging war against the State and defamation under the IPC.

On February 21, members of RSS student wing ABVP had gathered outside the college and shouted slogans in protest against a seminar for which JNU students Omar Khalid and Shehla Rashid were invited. The ABVP members allegedly pelted stones, vandalised the venue and disrupted the seminar.

The next day violent clashes erupted between Left and ABVP students leaving several students and three teachers injured.

Allahabad HC seeks reply on petition challenging constitution of Noida

The Allahabad High Court today directed Uttar Pradesh’s Principal Secretary (Urban Development) to file a counter affidavit on a petition challenging constitution of the Noida Sports Trust.

A Division Bench comprising Justice Arun Tandon and Justice Umesh Chandra Tripathi passed the order on the petition of District Tennis Association of Noida, which has challenged constitution of the trust by the Noida Authority.

The petitioner organization has contended that being a local body, it had no power to constitute such a trust.

It has been further alleged that officials of the Noida Authority were made members of the trust “not in the name of their respective designation or post but in their individual names”.

The court fixed July 6 as the next date of hearing in the matter.

Delhi HC seeks reply of Centre on LG’s order declaring urban areas

The Delhi High Court today sought the Centre’s response on a plea challenging constitutional validity of a notification issued by the Lieutenant Governor declaring 89 rural villages as urban areas.

A bench of Acting Chief Justice Gita Mittal and Justice C Hari Shankar issued notice to the Ministry of Home Affairs and the LG and sought their replies by October 25 on the plea filed by an NGO.

The petition filed through advocate Anil K Aggarwal has sought quashing of the LG’s May 16 notification which deemed some rural areas as urban, saying the Lt Governor had no jurisdiction to issue it and the move was “ultra vires” (beyond the legal power or authority) of the Constitution.

The NGO, Campaign for People Participation in Development Planning, in its plea claimed that by issuing such a notification, the LG was stepping into the domain of the Municipal Corporation of Delhi.

“The impugned notification (of May 16) has been issued by the LG without having power, authority and jurisdiction to do so under the Section 507 of the Delhi Municipal Corporation (DMC) Act,” the plea said.

Rajasthan HC wants cow to be declared national animal

The Rajasthan High Court today directed the state government to coordinate with the Centre and take necessary steps to declare cow as a national animal.

A single-judge bench of Justice Mahesh Chand Sharma said the chief secretary and advocate general of the state will be the legal custodians of the cow.

“Nepal is a Hindu nation and has declared cow as national animal. India is a predominant agriculture country based in animal rearing. As per Article 48 and 51A (g) it is expected from the state government that they should take action to get a legal entity for cow in this country,” he said in his order.

While Article 48 of the Constitution says the State should take steps for preserving and improving the breeds, and prohibiting the slaughter, of cows and calves and other milch and draught cattle, Article 51A(g) speaks of protecting natural environment and having compassion for living creatures.

“It is expected from the government that it should declare cow as national animal and for this purpose the Chief Secretary and Advocate General of state are declared legal custodians of cow,” the judge said in a 145-page order.

The direction was made while the court was hearing the Hingonia Gaushala matter. Over a hundred cows had perished at the government-run cowshed in Jaipur last year.

The bench also granted liberty to any person or class of persons to approach court with a plea in a PIL to declare cow as a national animal.

The direction comes at a time when many states are protesting the government’s decision to impose ban on the slaughter of cattle, primarily cows, for commercial purposes.

Automobile dealers based near Bengaluru’s Bellandur lake failed to get reprieve today from the National Green Tribunal which refused to set aside their closure order.

A total of 76 polluting industries around the lake were shut down by the authorities in pursuance to the green panel’s order after a mound of garbage was set on fire in February this year, leading to massive pollution in the area.

A bench headed by NGT Chairperson Justice Swatanter Kumar issued notices to the Karnataka government, Lake Authority of Bangalore, state pollution control board and Central Pollution Control Board and sought their reply on the plea of car dealers within a week.

“You are making it difficult for the people to breathe and live their life. People are coming to the court saying there are deaths taking place due to the pollution. How can you do it?

“You are not maintaining any record of the hazardous waste generated by you. Show us the mechanism or any document as to how you collect the waste. We are not going to do anything,” the bench said.

The counsel appearing for the automobile dealers told the bench that the authorities have shut down their units which were located more than 15 km away from the lake.

He said they were strictly complying with all the norms and not discharging any effluent in the Bellandur lake.

“The audit report by Maruti shows strict compliance by us. If any of the dealers does not comply with regulations, the dealership is instantly cancelled. We are in no way responsible for pollution in the lake. In fact, those units should be closed which have released effluents,” he said.

The matter was listed for next hearing on June 8.

The tribunal had earlier directed authorities to ensure the closure of 76 polluting industries around Bengaluru’s Bellandur lake and ordered the city’s Deputy Commissioner and the authorities to ensure immediate disconnection of water and electric supply to these industries.

It had also directed that housing societies and residential complexes near the lake will have STPs working within the prescribed parameters, failing which their power and water supply will be snapped too.

The green panel had directed the joint inspection team comprising officials from Bangalore Water Supply and Sewerage Board and the state pollution control board to jointly inspect all sewage treatment plants (STPs) that have been installed by housing societies and residential complexes near the lake.

Slamming the local civic bodies for inaction, the bench had banned dumping of any kind of municipal solid waste around the lake and announced an environment compensation of Rs five lakh on anyone found dumping waste in and around the lake.

Earlier, the NGT had lashed out at the Karnataka government and its agencies responsible over lack of maintenance of the Bellandur lake, asking them why they should not be prosecuted for negligence.

It had earlier issued notice to the Union Environment Ministry, the Karnataka government, Lake Authority of Bangalore, state pollution control board and Central Pollution Control Board in the case.

On February 20, the NGT had taken cognisance on its own of media reports and photographs of the incident in which a fire broke out in the Bengaluru lake.

“It is reported that there were thick clouds of smoke which severely hit traffic and people living around the lake.

It is also reported that usually a pile of garbage around the lake is set on fire and there was total panic.

“Undoubtedly, such emissions are bound to be have an adverse impact on environment, ecology and human health. It is a matter which requires serious investigation, remedial measures and restoration of the lake to its original wholesome status,” it had said.

Thick clouds of white smoke persisted for several days in the air around the Bellandur Lake after the blaze.

NGT asks CGWA to act against Noida water bottling unit

The National Green Tribunal (NGT) has directed the Central Ground Water Authority (CGWA) to take action against a Noida-based water bottling unit for extracting groundwater without requisite permission since 2009.

A bench headed by Justice Jawad Rahim passed the order recently after the Uttar Pradesh Pollution Control Board (UPPCB) said that the water supplier, Beltek Canadian Water Ltd, had not obtained the CGWA’s consent.

“CGWA is directed to take appropriate action, pass appropriate orders as permissible under law and file report before the next date of hearing after serving copy to the applicant,” the bench, also comprising Expert Member Nagin Nanda, said.

UPPCB’s counsel told the NGT that a joint inspection by the board and the Central Pollution Control Board (CPCB) found that the unit was extracting groundwater from the sensitive area without permission.

The matter is now listed for hearing on July 11.

The green panel had earlier imposed an environment compensation of Rs 10 lakh on the water bottling unit.

It had ordered a joint inspection of Beltek Canadian Water by the CPCB and the UPPCB to ascertain the exact number of tubewells installed at the unit and the quantity of water extracted.

It had directed the inspection team to specify the quantity of the water extracted, the nature of pollutants discharged from the factory and whether the area was over- exploited.

The tribunal was hearing a plea filed by Delhi resident Shailesh Singh, through advocate Sudeep Dey, alleging that the unit located in Bisrakh block of Gautam Buddh Nagar district was extracting groundwater through borewells installed in the factory premises without permission from the CGWA.

Man gets life sentence, three others 10 yrs jail in riot case

A Jalna court has sentenced a man to life imprisonment and awarded 10 years rigorous imprisonment (RI) to three persons and one year RI to 17 others for killing two men and rioting at Seweli here in 2008.

District and Sessions judge S S Kosamkar yesterday convicted a total of 21 persons and acquitted 10 others.

Shaikh Khaja Qureshi (31) was sentenced to life imprisonment. The judge also imposed a fine of Rs 5,000 on him and the three convicts, who were awarded 10 years jail.

Seventeen others were slapped with a fine of Rs 7,700.

According to special government prosecutor, Sanjiv Deshpande, a communal riot broke out over playing of an objectionable song at a pan kiosk at Seweli on April 3, 2008.

Two persons — Baliram Jadhav and Santosh Gavalkar — were killed, while five others injured in the riot.

Police had registered cases against 33 persons, of whom two died during the trial.

The judge examined 32 witnesses during the hearing.

Statements of investigating officer V D Nikam, doctors Prakash Ujgare and Murlidhar Waghamre and the three injured persons proved crucial in the case.
